Speeding Fine

Hi there, beware of your speed if you are not already. If your van weighs over 3.5 tonne watch your speed. I was sent an €80 fine for driving 97km in a 100km zone. On the assumption that I was over 3.5 tonne I should only be doing 80km. I now have to get my van weighed and send this cert off to the Gardaí to show I am under this weight.

Thanks for that I wasn't aware of it as I am over 3.5 tonnes. It's all very confusing.

Hi, I went through the same thing last year, search penalty points and you will find the posts. I think that Motorhomes over 3.5 ton are allowed to drive at the same speed as those under. Another craic member was fined for speeding in his American RV going to the first Kilkenny meet earlier this year and won his appeal. I think the speed vans think you are a large commercial van and in my case I cant blame them as our motorhome was imported from Germany and the registration cert have a lot of details down as unknown.

My van is ROI first reg. and has alot of unknowns on it too ,no axils, no width its a dream to drive . I think you have to check your reg cert and under section (J) there should be the letter M not N the N is a commercial vehicle and thats where they get you

There is no confusion about the weights on my vehicle - it is all clearly stamped on metal plate and riveted on to the chassis.

However there is confusion in my mind about what speed I should be driving at from a legal or regulatory standpoint.

In my older years I have tended to drive at the slower of what might be the correct speed limits.

"A not so young man, no longer in a hurry" perhaps 8-)

I got fined in the rv which is over 7.5 tonne on the way to Kilkenny and got it quashed on appeal we are treated the same as cars re speed limit I will look up the reply tomorrow and post re what to appeal on :)

Appeal that fine under Staturtory instrument 75 of 2012 it is the current legalisation governing the speed limit of camper vans which exceed 3,500 KG in weight as they are not restricted to a reduced speed limit.
Contact inspector john J Mc Donald at the fixed charge processing office Parnell Street Thurles
Expect to be told that excessive is the main cause of accidents etc hope that helps

Hi one and all,

Thanks for all that. When I rang the Gardaí in Thurles they told me it was only weight related, not van specific. As the sticker on my van says 3500 I can go to the local Garda Station and get them to verify it, I'll then send that info to Thurles. I'll fill you in when I'm finished. Thanks again.

wondered about this several times. same goes for driving over a 3.5t bridge - I've had my registered weight upgraded to 3.7 from 3.4 so that i can legally carry more weight, but... what if i actually weigh less than 3.5t ???

I am led to believe that it is the weight the vehicle is registered at not what you are actually carrying.

Thanks again for all info. Have got van emptied and weighed at 3040Kg. Brought info to local sgt who is sending info to Thurles. It should not be perused according to him. When I hear back I'll report.

Where are you? (see location link in my signature)

If you are in the UK the important weight is the unladen one - anything over an unladen weight of 3.05 tonnes is restricted.

Is your van tested? if so there should be a weight docket for testing, I sent in a copy of the weight docket and test to Thurles last year and they removed the penalty points with out any bother.

I'm based in wicklow town and when the van was tested they didn't weigh it. They were the first crowd I called for the weight. I will get it weighed at the next test and get them to put it on the cert. The sgt. I spoke to suggested this also. I'm still waiting to hear the outcome.

I saw Red when I got the penalty points at first, but it appears to happen regularly so I don't think you need worry. I dealt directly with Thurles and the Lady on the phone was very nice and was used to dealing with similar Motorhome speeding fines.

It makes such a difference when the person at the other end of the phone is nice. I've got to phone the Tax people tomorrow so I hope I get the same experience.
