A member of Motorhomecraic spoke to an employee on Saturday, the gates were shut Friday night and now the place is cleared according to him.

Can the liquidators put claim on my van? I haven't received the invoice yet and don't suppose I will now?
If it was showing on their stock list, can they do so?, I hpi checked it etc beforehand and all was clear
Not sure what happens there John, but I doubt they could do much. I would think as long as you have evidence of paying for it, bank withdrawl or similar you would be ok. But that's just an assumtpion.
I heard a while back that they were in trouble and auto trail had removed all their vehicles and dealership from them. This has now been passed onto abbey caravans. I was past on Saturday and it didn't look any more bare than what it did after all the auto trails were removed, I will try to go by tomorrow on the way home from work and see if anything has changed.
Before anyone asks why I didn't say anything a few weeks ago, it's because it was a rumour and I couldn't confirm anything apart from the auto trail bit, which was the same type of rumour i have heard about another dealer not that far from savilles and they are still in business

If it's true it's so sad and a sign of the state that our economy is in. It's hard to understand when John Lewis wants to come to Sprucefield that the powers that be won't grant planning permission. I'm beginning to wonder when I retire in June if we wouldn't be better selling up and getting out of this place. I'm beginning to think if the folk on the hill had brains they would be dangerous.

"It is with deep regret that unfortunately Saville Motorhomes has had to be put into administration. As some of you may know we were involved in zero rating new motorhomes for disabled customers who were wheel chair users. Although we followed all the requirements in Vat Notice
701/59 to the law, HMRC vat have stated that the specific modifications carried out by us and listed in their vat notice as acceptable are no longer "substantial" enough in their opinion. Despite our auditors, bankers and vat consultants being comfortable with our case , HMRC have decided to disregard various case law and previous VAT tribunals which they have lost. In both our advisors and our opinion, we believe HMRC intend to make a test case of Savilles. We have unfortunately been left with the decision to either pay HMRC several hundred thousand pounds of VAT which we never had in the first place or go to court to prove our vat zero rating was correct. Court action has been estimated to initially cost in excess of £100,000 and could result in a long protracted battle cost thousands more. As a company we are not in a position to financially expose ourselves to such litigation costs and have come to the decision to place Savilles into administration due to HMRC actions. We would like to state that no customers who purchased their motorhomes zero rated are liable in any way for any VAT to HMRC and wouldlike to thank all of our customers for their support over the years."
i just need to know if my Autotrail was showing on their stock list before the business was closed up, if it was then there is every chance the administrators will put claim to my new van!?
if so, then it will leave me with nothing and £48k out of pocket, and my previous van will have dissappeared.

Its is with deep regret that the directors of Saville Motorhomes have had to place the company into administration.
As some of you may know we were involved in the zero rating of new motorhomes for disabled customers who were wheel chair users. Although we followed all the requirements set out in Vat Notice 701/59 to the letter, HMRC vat have stated that the specific modifications carried out by us and listed as acceptable examples in their vat notice are in their opinion no longer "subtantial" enough. Despite our various business/tax consultants being comfortable with our case, HMRC vat have decided to disregard case law and previous court cases which they have lost in order to pursue Savilles.
In our opinion and that of our tax advisors we believe HMRC intend to make a test case of Savilles at whatever cost. We have unfortunately been left with the decision to either pay HMRC several hundred thousand pounds of VAT which is not due to them and which we never had or go to court to prove our case. Our advisors have estimated legal costs would be well in excess of one hundred thousand pounds and could result in a long and protracted case.
Both as a company and as private individuals, and despite our principles, we can not expose ourselves to such uncertain costs and have come to the painful decision to place Savilles into adminstration due to HMRC actions.
We would like to state that no disabled customers who purchased their motorhomes with zero rated vat are liable to pay any vat to HMRC.
Finally we would like to thank all our customers, employees and suppliers for their support over the years since Savilles was founded in 1945.
All customers vehicles are on site and can be collected from the administrator Keenan Corporate Finance. Please call 028 90447153 to arrange a time for collection.
If its still covered by a manufacturers warranty, then arrangements can be made to have either an authorised repairer or another dealer to cover it, but if its outside of that and one issued by savilles then it's probably gone

What a nightmare. I thought the government was at all times supposed to act 'reasonably and proportionally' under Human Rights? Does this seem reasonable and proportionable to you?

Does not, ridiculous - forcing a business to close in these times is disgraceful.

Although on the other side of the coin, there is always another side - most of us know someone with a VAT free MH as they have a DLA registered family member they are supposed to bring with them when they travel in the MH, which of course never happens.
Would I do the same myself if the option was offered? probably.

HMRC have no hesitation forcing business to close as it is their responsibility to collect as much in taxes for the government as possible. If there is any chance of squeezing a few quid extra even pushing previous judgements which have gone against them then they will, they have no no compassion towards any company or individual.
