In law a public place is defined thus “public place” means any street, road or other place to which the public have access with vehicles whether as of right or by permission and whether subject to or free of charge; I would therefore ask, on what grounds can a motorhome be we denied permission to park at such places which would withstand a charge of unjustified discrimination, particularly if the vehicle is fully 'road' legal.
The last paragraph is all the information I need. Don't sit behind the wheel and don't sit in a forward facing driving seat.
As I have always said, I will carry on doing what I am doing, having a drink in the MH, with the Motorhome disabled from driving and then sleeping it off.
If your silver screens are up, bed made up, seats turned around, tables out, shoes off etc. I doubt there is a court in the land could get a conviction on the grounds you were going to drive. I don't think any Police man or woman would even consider trying to prosecute you, unless of course you are being an arse.
Surely if the "public" as in "ALL the public" cannot gain access then it cannot be a "public" place.
Therefore surely nowhere that has access restricted by a height barrier can be deemed to be a "public place".
I would turn that argument around.
If it's a public place it's unlawful to obstruct access without good reason, such as to preserve public order or prevent environmental damage or satisfy public health and safety concerns.

I took it, it was only a public place during licensing hours. The fact that the van is there, is because the landlord invited you to stay. Sort of. As for other places, if you se common sense no beak would entertain a case and the DPP would probably know that. More Guinness sir?
I would have thought it would not have been in the public interest to prosecute in a case of that nature.
I cannot see CPS allowing it to go as far as court as they would know fine well that you could provide a strong case for your defence.
